By accessing or using the American Civic Action website ("Site") or any services provided by American Civic Action ("we," "our," or "us"), including but not limited to text messaging services, you agree to be bound by these Terms of Service ("Terms"). The following terms govern your participation in the American Civic Action text messaging program. By opting in to receive text messages, you agree to these terms in addition to our general Terms of Service and Privacy Policy.

Consent and Enrollment
By providing your mobile phone number and affirmatively opting in to receive text messages from American Civic Action (by checking an opt-in checkbox, texting a keyword, or other explicit consent mechanism), you expressly consent to receive recurring automated promotional and informational text messages from American Civic Action at the mobile phone number you provided.

How to Opt Out
You may opt out of receiving text messages from American Civic Action at any time by texting STOP to any message you receive from us. You may also text STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to stop receiving messages.
After you send STOP, you will receive a one-time confirmation message confirming that you have been unsubscribed. You will no longer receive text messages from American Civic Action unless you opt in again by re-enrolling in our text messaging program.

No Mobile Information Sharing
American Civic Action will not sell, rent, lease, or share your mobile phone number or any personal information collected in connection with our text messaging program with any third parties for their promotional or marketing purposes.

Cost and Charges

Contributions to American Civic Action are not tax-deductible as charitable contributions for federal income tax purposes.

We do not warrant the accuracy or completeness of any information on the Site or delivered via text message. We do not guarantee message delivery, which is dependent on your mobile carrier.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AMERICAN CIVIC ACTION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND MOBILE CARRIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE, SERVICES, OR TEXT MESSAGING PROGRAM.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE, SERVICES, OR TEXT MESSAGING PROGRAM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.
MOBILE CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES.
Indemnification
You agree to indemnify, defend, and hold harmless American Civic Action and its officers, directors, employees, agents, and mobile carriers from any claims, liabilities, damages, losses, or expenses arising from your use of the Site or services, your participation in the text messaging program, your violation of these Terms, or your infringement of any third-party rights.
Dispute Resolution
Any disputes arising out of or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and American Civic Action regarding your use of our Site and services, including our text messaging program.
