By accessing or using the American Civic Action website ("Site") or any services provided by American Civic Action ("we," "our," or "us"), including but not limited to text messaging services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

American Civic Action is a 527 political organization dedicated to promoting civic engagement, voter participation, and political education. Our services include:

Text Messaging (SMS/MMS) Terms of Service

The following terms govern your participation in the American Civic Action text messaging program. By opting in to receive text messages, you agree to these terms in addition to our general Terms of Service and Privacy Policy.

Consent and Enrollment

By providing your mobile phone number and affirmatively opting in to receive text messages from American Civic Action (by checking an opt-in checkbox, texting a keyword, or other explicit consent mechanism), you expressly consent to receive recurring automated promotional and informational text messages from American Civic Action at the mobile phone number you provided.

Message delivery and compatibility may vary by carrier. Carriers are not responsible for delayed or undelivered messages.

No Mobile Information Sharing

Cost and Charges

American Civic Action does not charge for text messages. However, message and data rates may apply based on your mobile carrier's plan. You are responsible for any message or data charges imposed by your carrier. Check with your mobile carrier for pricing and plan details.

Changes to SMS Terms

We may modify these SMS terms at any time. If we make material changes, we will notify you by text message or by posting updated terms on our website. Your continued participation in our text messaging program after any changes constitutes acceptance of the modified terms.

User Conduct

When using our Site and services, you agree not to:

• Provide false or misleading information, including providing a mobile phone number that is not your own
• Use the Site for any unlawful purpose

Donations to American Civic Action are processed through secure third-party payment processors. By making a donation, you represent that you are making the contribution with your own funds and are not acting as an agent for another person or entity.

Disclaimer of Warranties

THE SITE AND SERVICES, INCLUDING TEXT MESSAGING SERVICES, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site or text messaging services will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant the accuracy or completeness of any information on the Site or delivered via text message. We do not guarantee message delivery, which is dependent on your mobile carrier.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AMERICAN CIVIC ACTION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND MOBILE CARRIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE, SERVICES, OR TEXT MESSAGING PROGRAM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE, SERVICES, OR TEXT MESSAGING PROGRAM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

MOBILE CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES.

Indemnification

You agree to indemnify, defend, and hold harmless American Civic Action and its officers, directors, employees, agents, and mobile carriers from any claims, liabilities, damages, losses, or expenses arising from your use of the Site or services, your participation in the text messaging program, your violation of these Terms, or your infringement of any third-party rights.

Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and American Civic Action regarding your use of our Site and services, including our text messaging program.
